Terms of Service

1. Agreement to Terms

Welcome to addlinq, a company registered in Colombo, Sri Lanka. By accessing or using our digital profile platform and related physical products, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and addlinq. We reserve the right to modify these Terms at any time. We will notify you of any changes through our in-platform notification system. Your continued use of the service after such modifications constitutes your acceptance of the updated Terms.

2. Service Description

addlinq provides a digital profile platform combined with physical products including NFC-enabled business cards, mini cards, badges, stands, and apparel. Our service includes:

  • Digital profile creation and management
  • QR code and NFC sharing capabilities
  • Built-in CRM and analytics tools
  • Physical products that connect to your digital profile
  • Profile customization and link management

Our platform operates on a freemium model with Free, Pro, and Team subscription tiers. For current pricing, please refer to our pricing page as rates may change over time.

3. Account Registration and Eligibility

Age Requirement: You must be at least 13 years of age to create an account and use our services. Users under 18 should have parental or guardian consent.

Account Creation: You may create multiple accounts using different email addresses. Each account requires a unique email and username. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Types: You may choose between Personal and Organization dashboard types. Each account type provides different features suited to individual professionals or business teams.

Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Subscription Plans and Pricing

Subscription Tiers: addlinq offers Free, Pro, and Team subscription plans. Features and pricing vary by tier and are subject to change. Please visit our pricing page for current plan details.

Payment: Subscription payments are processed via card payments through PayHere. Product purchases can be paid via bank transfer or card payment. Payment instructions will be provided upon checkout.

Billing: Subscriptions are billed according to the plan you select. You will receive an invoice for each billing period.

Auto-Renewal: Currently, subscriptions do not auto-renew. You will need to manually renew your subscription when it expires. We will notify you before your subscription expires.

No Free Trials: We do not currently offer free trial periods for paid subscriptions. However, our Free plan is available indefinitely at no cost.

5. Refund Policy

Subscription Refunds: Pro and Team subscriptions are eligible for a prorated refund within 14 days of purchase if you are unsatisfied with the service. To request a refund, contact us at addlinq.official@gmail.com with your account details and reason for the refund request.

Physical Product Refunds: Physical products (NFC cards, badges, stands, apparel, etc.) are non-refundable. However, we offer exchanges for damaged products within the warranty period.

Refund Processing: Approved refunds will be processed within 7-10 business days via the original payment method.

6. Physical Products

Product Warranty: All physical products come with a 6-month warranty against manufacturing defects, provided the product has not been physically damaged by the user. Products that are unused and in original condition may be exchanged on a 1-to-1 basis within the warranty period.

Product Features: Our NFC-enabled products support unlimited scans, are scratch and water-resistant, and work without requiring the recipient to download an app. Specific dimensions and features are listed on each product page.

Shipping: Physical products are shipped via courier or postal service to your specified address. Shipping costs and delivery timeframes will be communicated at checkout. We are not responsible for delays caused by courier services or postal systems.

Product Availability: Some products may be marked as "Coming Soon" or "Not Available." We reserve the right to discontinue products or temporarily suspend availability.

7. User Content and Data Ownership

Your Content: You retain full ownership of all content you upload to your addlinq profile, including text, images, links, and other information. By using our service, you grant addlinq a limited, non-exclusive license to use, store, and display your content solely for the purpose of providing our services within Sri Lanka.

Content Standards: You agree not to upload, share, or display content that is:

  • Illegal, offensive, defamatory, or obscene
  • Hateful, discriminatory, or promotes violence
  • Fraudulent, misleading, or deceptive
  • Adult content or sexually explicit material
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or malicious code
  • Spam or unsolicited commercial content

Content Moderation: We reserve the right to monitor and review user content when reported by other users. Content that violates our standards will be removed, and the account owner will be notified.

Data Export: You may export your profile data and content at any time through your account settings.

8. Privacy and Data Collection

Data Collection: We collect the following information:

  • Account information: email address, username, password (encrypted), and dashboard type
  • Profile information: name, contact details, social links, bio, and uploaded images
  • Usage analytics: profile views, link clicks, and engagement metrics
  • Device information: browser type, IP address, and device identifiers (for analytics)

Data Storage: All user data is stored securely on AWS (Amazon Web Services) servers located in Singapore. We implement industry-standard security measures to protect your data.

Data Sharing: We do not sell or share your personal data with third parties, except with our trusted service partners necessary to operate our platform:

  • AWS (cloud hosting and storage)
  • Resend (email delivery service)
  • Our built-in analytics system (no third-party analytics trackers)

Sensitive Data: We do not store sensitive financial information such as credit card numbers or bank account details. Card payments are handled securely through PayHere, and bank transfer information is processed securely.

Data Protection Compliance: We are based in Sri Lanka and operate under Sri Lankan law. Our services are intended for use by individuals and businesses within Sri Lanka.

9. Acceptable Use Policy

You agree to use addlinq services only for lawful purposes and in compliance with all applicable laws and regulations. You must not:

  • Use the service to harass, abuse, or harm other users
  • Create fake profiles or impersonate others
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service or servers
  • Use automated scripts or bots without permission
  • Engage in spamming or unsolicited marketing
  • Violate intellectual property rights
  • Use the service for fraudulent or illegal activities

Commercial Use: You may use addlinq for commercial purposes, including business networking, marketing, and lead generation, provided you comply with all applicable laws and these Terms.

10. Account Suspension and Termination

Violations: We reserve the right to suspend or terminate accounts that violate these Terms. The duration and type of action depends on the severity of the violation:

Temporary Suspension (1 month): Applied for first-time or minor violations such as:

  • Posting inappropriate but non-malicious content
  • Minor spam or commercial policy violations
  • Unintentional terms violations

Permanent Ban: Applied for serious or repeated violations such as:

  • Fraudulent activities or payment fraud
  • Harassment, threats, or abusive behavior
  • Illegal content or activities
  • Repeated violations after warnings
  • Severe breaches of content standards

Warning System: Users will receive warnings through our in-platform notification system before suspension or termination, except in cases of severe violations where immediate action is required.

User-Initiated Termination: You may delete your account at any time through your account settings. Accounts are never terminated unless you request it or violate our Terms.

Data After Termination: Upon account deletion, your profile will be removed from public view immediately. Before permanent data deletion, we will ask your permission to retain your email address for notifications about new products or features. If you decline, all your data will be permanently deleted within 30 days.

11. Reporting Violations

Report System: If you encounter content or behavior that violates these Terms, you can report it using the "Report This" button available on user profiles.

Review Process: All reports are reviewed by our team. We aim to respond to and resolve reports within 4 business days. You will be notified of the outcome through our notification system.

False Reports: Submitting false or malicious reports may result in action against your own account.

12. Intellectual Property Rights

addlinq IP: All intellectual property rights in the addlinq platform, including software, design, trademarks, and proprietary features, are owned exclusively by addlinq. The service is protected by copyright, trademark, and other intellectual property laws of Sri Lanka.

Your Content: You retain all ownership rights to content you create and upload. By using our service, you grant us only the rights necessary to operate and provide the service to you.

Trademarks: The addlinq name, logo, and related marks are trademarks of addlinq. You may not use our trademarks without our prior written permission.

Third-Party Services: We integrate with various third-party services and APIs. You are responsible for complying with the terms of service of any third-party platforms you link to your profile.

13. Service Availability and Modifications

Uptime: While we strive to maintain continuous service availability, we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or unforeseen technical issues.

Updates and Features: We regularly release new features and improvements. We reserve the right to modify, add, or remove features at our discretion. Major changes will be communicated through our notification system.

Beta Features: Some features may be designated as beta or experimental. These features are provided "as is" and may have limited functionality or stability.

14. Disclaimers and Limitation of Liability

Service "As Is": The addlinq service and physical products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Results: While we provide tools for networking and lead generation, we do not guarantee any specific business outcomes, connections, or opportunities.

Limitation of Liability: To the maximum extent permitted by Sri Lankan law, addlinq shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or data loss
  • Errors or inaccuracies in content
  • Actions of third parties or other users

Maximum Liability: Our total liability to you for all claims arising from or related to these Terms or your use of the service shall not exceed the amount you paid to addlinq in the 12 months preceding the claim, or LKR 10,000, whichever is greater.

Physical Products: Our liability for physical products is limited to repair, replacement, or refund (at our discretion) under the warranty terms outlined in Section 6.

15. Indemnification

You agree to indemnify, defend, and hold harmless addlinq, its officers, directors, employees, partners, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) content you upload to the service.

16. Governing Law and Dispute Resolution

Governing Law: These Terms and your use of the service shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.

Jurisdiction: You agree that any legal action or proceeding arising out of or related to these Terms or your use of the service shall be brought exclusively in the courts of Colombo, Sri Lanka, and you consent to the jurisdiction of such courts.

Dispute Resolution: In the event of any dispute, we encourage you to contact us first at addlinq.official@gmail.com to attempt to resolve the matter informally. We are committed to working with our users to reach a fair resolution.

17. Changes to Terms of Service

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will notify you through:

  • Our in-platform notification system
  • Email to your registered address (for significant changes)
  • Prominent notice on our website

Your continued use of the service after such notification constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should discontinue using the service and may close your account.

18. Miscellaneous Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and addlinq regarding your use of the service and supersede all prior agreements.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or any rights hereunder without restriction.

Language: These Terms are written in English. Any translations are provided for convenience only. In case of any conflict, the English version shall prevail.
